Packaging and packaging waste: amendments to directive 94/62/EC

On June 14th 2018 Directive EU/2018/852 was published in the Official Journal of the European Union, thus amending Directive 94/62/EC on packaging and packaging waste.
This amendment is part of the European Union’s framework regarding circular economy.
In this context packaging waste management became one of the priorities and additionally, a revision regarding packaging waste imposed itself.
In parallel to a number of definition changes, other important adaptations were introduced:
• An extension of article 5 regarding reuse
• New minimum goals for recycling

A number of amendments to Directive 94/62/EC were voted during the plenary meeting of March 14th 2017. This concerned however the so-called first lecture. Following this, the proposed amendments still needed to be approved by the Council.
Meanwhile several changes to the proposed amendments were introduced in agreement with the European Parliament and the Council. This resulted in the Directive EU/2018/852

In parallel to a number of definition changes, other important adaptations were introduced:
• An extension of article 5 regarding reuse
• New minimum goals for recycling, in particular:

at the latest by December 31st 2025 at least 65 weight percent of all packaging waste is recycled;
at the latest by December 31st 2030 at least 70 weight percent of all packaging waste is recycled;

minimum goals for recycling which need to be achieved for the following specific materials, present in packaging waste:

at the latest by December 31st 2025:                   at the latest by December 31st 2030:
50 weight percent of plastics;                                 55 weight percent of plastics;
25 weight percent of wood;                                     30 weight percent of wood;
70 weight percent of ferrous metals;                    80 weight percent of ferrous metals
50 weight percent of aluminium;                           60 weight percent of aluminium
70 weight percent of glass;                                    75 weight percent of glass;
75 weight percent of paper and cardboard         85 weight percent of paper and cardboard

This Directive enters in force on July 4th 2018.
Since this is a Directive, the members states will need to convert this directive into national law-making and this at the latest by July 5th 2020.
